Cocinero’s vehicle struck by reckless driver on East W.T. Harris Boulevard
CHARLOTTE, NC, (February 04, 2021) – Estuardo Menchu Cocinero was tragically killed in a head-on crash with a drunk driver on Thursday, February 4th in Charlotte.
Cocinero’s vehicle was struck by a 2016 Maserati Ghibli S luxury car driven by 34-year-old Kevin Samkia at about 1:30 p.m. on East W.T. Harris Boulevard. According to Charlotte-Mecklenburg Police, Samkia was speeding when he careened across a grassy median, striking Cocinero’s Toyota Scion. After being released from the hospital, Samkia was charged with felony death by vehicle, driving while impaired and reckless driving.
RECKLESS DRIVING CRASH INVESTIGATION
Sadly, each year, approximately 36,000 people are killed and another 1.9 million people are injured in motor vehicle crashes in this country.
Many of these crashes are caused by reckless driving, which includes road rage, tailgating, drunk driving, distracted driving speeding, and erratic lane changes. In this crash, liability on the part of Mr. Samkia appears clear as he was driving while impaired, one of the most dangerous and reckless things that a driver can do.
An independent investigation will be required to learn other potential factors in the case, including the results of a test or tests to determine the blood-alcohol content of Samkia. Candice Bond, an experienced auto accident attorney, said in cases such as this that it is imperative to have an independent investigation conducted to preserve evidence for a victim’s family.
“An attorney can collect the proper evidence to help prove that a driver’s actions were reckless, which requires a variety of resources,” said Bond, Managing Partner of Bond Legal. “In addition to the diligent work of law enforcement, an attorney can re-interview important witnesses, analyze any surveillance video from the scene of the crash, and obtain phone and texting records of the liable party. Serving as an advocate, an attorney can compassionately guide the grieving family of a victim during this difficult time, vigorously protecting their legal rights and best interests, while holding a reckless driver accountable for their actions.”
WRONGFUL DEATH CLAIM
Pending an investigation, the family of Estuardo Menchu Cocinero may be entitled to a wrongful death claim for medical and funeral expenses, the loss of love and companionship, pain and suffering, and emotional trauma.
“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in a person’s death,” Bond added. “When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”
